The subject of this call for tenders is the assessment of the human and other resources available to the EU Agency for the Cooperation of Energy Regulators (ACER) in relation to ACER’s tasks with the following general objectives:

  • Identifying if ACER makes the most appropriate use of financial and human resources to achieve its objectives and undertakes its tasks in a cost-effective way and, if applicable, how and to which extent cost-effectiveness could be improved.
  • Identifying whether the financial and human resources available to ACER allow it to fulfil its role under EU legislation and, if not, which impact the lack of resources has on ACER’s performance and how the situation could be improved, both as regards quality (e.g. more appropriate internal processes) and as regards quantity (required additional resources to achieve desired performance levels).

The first point is related to the planned changes to ACER’s funding: From 2021 onwards ACER will have the power to levy fees for collecting, handling, processing and analysing of information reported by market participants or entities reporting on their behalf pursuant to Article 8 of Regulation 1227/2011 on wholesale energy market integrity and transparency (REMIT). Eligible costs are to be identified in ACER’s programming document which ACER has to adopt before the end of this year. Costs funded by fees shall stem from tasks/services provided in a cost-effective way and the assessment shall provide proof that this is the case.

A large REMIT-related cost pool is the REMIT Information System. Contractors are therefore expected to have expertise in assessing performance and costs of IT systems.

Contractors will be required to perform the assessment in a relatively short time span: it is envisaged that the assessment shall be based on information collected at ACER premises in Ljubljana, Slovenia, in September/October and a draft final report should be ready by end of October 2020.

Maximum amount: 125.000 €

Economic operators who do not express their interest before the deadline will not be invited to submit an offer. The latter restriction will not apply to the minimum five economic operators directly invited by the Commission
