Targeted Consultation to support the establishment of a new network code on demand response

The target audiences are public authorities (Member States and EEA countries, regional and local authorities), National Regulatory Authorities (NRAs), power exchanges including local market platform operators, Transmission System Operators (TSOs), Distribution System Operators (DSOs), electricity market participants, consumer groups, business associations, and environmental NGOs.

On 7 March 2025, the Commission received ACER’s proposal for an EU-wide network code on demand response established by Regulation (EU) 2019/943 Article 59(1)(c).

The proposal, stemming from an initial draft jointly submitted by the EU Distribution System Operators Entity (EU DSO Entity) and the European Network of Transmission System Operators (ENTSO-E) and amended by ACER included a proposal for a new network code on demand response and amendments to  three related electricity regulations: the electricity balancing guideline (Regulation (EU) 2017/2195), the system operation guideline (Regulation (EU) 2017/1485) and the demand connection network code (Regulation (EU) 2016/1388).

Following its submission, the Commission is currently reviewing ACER’s proposal and aims at informing its work with this stakeholder consultation. 

Your input will support the development of a robust legislative instrument that lays down new rules on demand response, enhances flexibility and interoperability with a focus on decentralised assets, addresses regulatory barriers for the development of demand response and fosters a harmonised framework for the functioning and integration of the EU electricity system.
