Investors, public authorities, nuclear regulatory authorities, industry associations, trade unions / workers' representatives, non-governmental organisations, suppliers of equipment or technology for nuclear projects or of nuclear material or nuclear fuel, service providers for nuclear projects/facilities (including nuclear fuel cycle services), subcontractors involved in nuclear investment projects, researchers, other relevant stakeholders and citizens (inside and outside of the European Union).

Why we are consulting

Objective of the consultation

This public consultation seeks the views of stakeholders and other interested parties on the need for a revision of the existing information and procedural requirements under Articles 41 to 44 of the Euratom Treaty. Under the current legal framework, the Commission reviews nuclear investment projects scheduled in EU countries and examines their compatibility with the Euratom Treaty. Projects which must be notified to the Commission include mining of uranium ore, manufacturing of nuclear fuel elements, production of enriched uranium and nuclear reactors of all types and for all purposes.

Current arrangements make it difficult for investors to identify which projects must be notified, what information should be provided and how the information should be communicated to the Commission. Moreover, since the adoption of the relevant legal acts, new Directives have come into force on nuclear safety, spent fuel and radioactive waste management and decommissioning, and radiation protection which will require these legal acts to be updated.

The Commission is therefore seeking views on how the legal framework in this area could be clarified, streamlined or updated.

Initially, the questionnaire will only be available in English, French and German. More languages will be added later.
