Why we are consulting

Objective of the consultation

Pursuant to Article 61 of the Electricity Regulation (EU) 2019/943 the Commission is empowered to adopt and amend binding guidelines in the areas listed in Articles 59 (Network Codes) and 61 (Guidelines). In this context the Commission seeks the views of ACER, the ENTSO for Electricity, the EU DSO entity and, where relevant, other stakeholders, as required by Art 61(6).

The planned Commission Implementing Regulation intends to clarify ambiguous wording in the provisions on the process for developing and approving more detailed joint rules under guidelines (Commission Regulations) governing key cross-border aspects of the electricity wholesale market in the EU and to align those provisions with the new Electricity Regulation (EU) 2019/943 and the ACER Regulation (EU) 2019/942 adopted in 2019.

Full title of the planned initiative is “Commission Implementing Regulation amending Article 9 of Commission Regulation (EU) 2015/1222 of 24 July 2015 establishing a guideline on capacity allocation and congestion management, Article 4 of Commission Regulation (EU) 2016/1719 of 26 September 2016 establishing a guideline on forward capacity allocation, Articles 4 to 7 of Commission Regulation (EU) 2017/2195 of 23 November 2017 establishing a guideline on electricity balancing and Articles 5 to 8 of Commission Regulation (EU) 2017/1485 of 2 August 2017 establishing a guideline on electricity transmission system operation in order to clarify the process for adopting terms and conditions or methodologies under those guidelines and in order to align the text of the above listed articles with the relevant provisions in Regulation (EU) 2019/943 of 5 June 2019 on the internal market for electricity and Regulation (EU) 2019/942 of 5 June 2019 establishing a European Union Agency for the Cooperation of Energy Regulators.”
